What is probate?

Probate is the court-administered process of transferring assets that are owned in a person’s individual name to their heirs or beneficiaries.  Probate is always necessary at some level whether or not the decedent has a will.  It can be a stressful process – especially during the emotional time period immediately after a loved one has just passed away.  Our attorneys can help facilitate a smooth ride through the probate administration process.

The Florida Probate Code is found in Chapters 731 through 735 of the Florida Statutes and the rules governing Florida probate proceedings are found in the Florida Probate Rules, Part I and Part II (Rules 5.010-5.530).
